Please read these Terms of Service carefully before using the GoFloaty platform. By creating an account, joining the waitlist, or using any part of the GoFloaty service, you agree to be bound by these Terms.
GoFloaty LLC ("GoFloaty," "we," "us," or "our") is an Arizona limited liability company operating an online marketplace platform that connects pool service businesses ("Businesses") with independent pool service contractors ("Contractors"). GoFloaty is a marketplace facilitator and is not a party to any service agreement between Businesses and Contractors.
GoFloaty is currently in pre-launch and accepting waitlist registrations. These Terms govern your use of our website at gofloaty.com, our mobile applications (when launched), and all related services.
To use GoFloaty you must: (a) be at least 18 years of age; (b) be a legal resident of the United States; (c) have the legal authority to enter into a binding contract; and (d) not be prohibited from using our services under applicable law.
Contractors must additionally: (a) hold a valid driver's license; (b) consent to and pass a criminal background check; (c) consent to and pass an MVD driving record check; and (d) provide valid government-issued identity documentation. CPO certification and ROC (Registered Pool/Spa Contractor) licensing are optional but affect the contractor's credential tier badge (Copper, Silver, or Gold) displayed on their profile.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
GoFloaty reserves the right to suspend or terminate any account that we reasonably believe contains false or misleading information, or that is being used in violation of these Terms.
Businesses may post job listings describing pool service work needed, including service type, schedule, and property information. Businesses agree that all information posted is accurate. Gate codes and property access information provided by Businesses will be held securely and disclosed only to the hired Contractor.
Contractors may browse job listings and submit bids with their quoted price. By submitting a bid, Contractors represent that they are qualified to perform the described work, are available for the specified schedule, and agree to the platform fee structure.
GoFloaty is a marketplace facilitator. We do not employ Contractors, supervise work, guarantee job quality, or assume liability for services performed. Contractors are independent contractors, not employees or agents of GoFloaty.
All Contractors on the GoFloaty platform are subject to background screening conducted by Checkr, Inc. or a similar third-party provider, as well as MVD driving record verification and CPO certification verification. By registering as a Contractor, you expressly consent to these checks in accordance with the Fair Credit Reporting Act (FCRA) and applicable state law.
GoFloaty reserves the right to deny or revoke platform access based on background check results, at our sole discretion. We will provide required adverse action notices in compliance with the FCRA.
Background check results and associated data are handled in accordance with our Privacy Policy and applicable law. GoFloaty does not share individual background check results with Businesses beyond displaying a verified/not-verified status badge on Contractor profiles.
GoFloaty charges a platform fee on each completed transaction. Businesses are billed at the agreed job price plus a 10% platform fee. Contractors receive the agreed job price minus a 10% platform fee. GoFloaty retains the spread as its service fee. These fees are subject to change with 30 days' notice.
Upon hire confirmation, Business funds are held in escrow by our payment processor (Stripe, Inc.) and released to the Contractor upon job completion confirmation. Funds are automatically released 48 hours after a Contractor marks a job complete if no dispute is raised by the Business.
If a Business raises a dispute, escrow funds are frozen pending GoFloaty's review. GoFloaty's dispute resolution decision is final and binding. GoFloaty is not liable for disputed amounts beyond the funds held in escrow.
All payments are processed by Stripe, Inc. By using GoFloaty, you agree to Stripe's Terms of Service and Privacy Policy. GoFloaty does not store credit card or bank account numbers on its servers.
Businesses may rate and review Contractors after job completion. Ratings must reflect genuine first-hand experience. GoFloaty prohibits fake, misleading, or retaliatory reviews. GoFloaty reserves the right to remove reviews that violate these standards.
GoFloaty's forgiveness system allows Contractors to improve their ratings over time through demonstrated quality work. GoFloaty reserves the right to adjust or recalculate ratings scores at any time in connection with the operation of this system.

All content on the GoFloaty platform — including the name "GoFloaty," all associated logos, software, design elements, and written content — is the intellectual property of GoFloaty LLC and is protected under U.S. and international intellectual property law. The "GOFLOATY" word mark is subject to pending USPTO trademark applications (Classes 035, 042, and 036).
You may not reproduce, distribute, modify, or create derivative works from any GoFloaty content without express written permission.
THE GOFLOATY PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GOFLOATY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. GOFLOATY MAKES NO WARRANTY REGARDING THE QUALITY, RELIABILITY, OR SUITABILITY OF ANY CONTRACTOR OR JOB LISTING ON THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOFLOATY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM. GOFLOATY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID BY YOU TO GOFLOATY IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless GoFloaty LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the platform, your violation of these Terms, or any services performed or received through the platform.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved by binding arbitration in Maricopa County, Arizona, under the American Arbitration Association Commercial Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
GoFloaty reserves the right to modify these Terms at any time. We will provide notice of material changes via email or prominent notice on the platform. Your continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.
GoFloaty may suspend or terminate your account at any time, with or without cause, with or without notice. Upon termination, your right to use the platform ceases immediately. Sections 9–13 survive termination.

GoFloaty uses industry-standard security measures including encryption in transit (TLS), encryption at rest, access controls, and regular security reviews. However, no method of transmission over the internet is 100% secure. We encourage you to use a strong, unique password and to contact us immediately if you suspect unauthorized access to your account.
The GoFloaty platform may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.
We may update this Privacy Policy from time to time. We will notify you of material changes via email or prominent notice on the platform at least 14 days before the changes take effect. Your continued use of GoFloaty after that date constitutes acceptance of the revised policy.
